DWI Penalties in Mississippi by Offense Level

Under Miss. Code Ann. § 63-11-30, both DUI and DWI refer to the same offense in Mississippi: operating a vehicle while impaired. The penalties you face depend heavily on your prior record and the circumstances of your arrest. First and second offenses within a five-year period are charged as misdemeanors; a third offense within that window becomes a felony.

First Offense DWI
Up to 48 hours in jail, a fine of $250 to $1,000, and a driver’s license suspension of up to 120 days. Mandatory enrollment in the Mississippi Alcohol Safety Education Program (MASEP), a state-required 12-hour course, is also imposed. First-time offenders may qualify for nonadjudication, a pathway that sets aside sentencing upon completion of MASEP, payment of all fines and fees, and installation of an ignition interlock device (IID) for the required period. Eligibility for nonadjudication is available only once under Mississippi law.

Second Offense DWI (within five years)
5 days to 6 months in jail, a fine of $600 to $1,500, a 1-year license suspension, mandatory substance abuse assessment, and IID installation. Collateral consequences include significantly higher auto insurance premiums, an SR-22 high-risk insurance requirement, probation, and community service.

Third Offense DWI (within five years)
This is a felony charge. A conviction carries 1 to 5 years in the custody of the Mississippi Department of Corrections and fines of $2,000 to $5,000. The driver’s license is suspended for five years, and upon release, the convicted driver may be eligible only for an ignition interlock-restricted license. Mississippi law does not permit the minimum penalties to be suspended or reduced. Trial is heard in Madison County Circuit Court, and the defendant may request a jury trial.

Aggravating factors that increase penalties at any offense level include having a passenger under age 16 in the vehicle or causing serious bodily injury or death. A first-offense DWI conviction may be eligible for expungement in Mississippi after five years of completing all sentence conditions, subject to eligibility requirements including a BAC below 0.16% and no CDL at the time of arrest. DWI drug convictions are not eligible for expungement under Mississippi law.
